Our Workmanship Policy

Introduction:

At The Drake Group, we are committed to providing our customers with high-quality manufactured items, exceptional services, and reliable repairs. Our workmanship policy outlines our dedication to ensuring your satisfaction and setting forth the standards we uphold in every aspect of our business.

1. Quality Assurance:

We guarantee that all manufactured items, services, and repairs provided by The Drake Group will meet or exceed industry standards. Our skilled professionals are trained to deliver consistent and superior workmanship, ensuring that you receive a product or service that is built to last.

2. Expert Technicians:

Our technicians and staff are experienced in their respective fields. They possess the skills and knowledge necessary to carry out manufacturing, services, and repairs with precision and efficiency.

3. Manufacturer’s Warranty:

New Trailers
Drake and O’Phee new trailers are guaranteed free of defects in material and workmanship under normal use and service, exclusive of normal wear, for a period of 12 months from the date of sale by Drake to its customer. The warranty is valid for the first purchaser only and not about products which:

• 1. Are installed by customers or third parties after date of sale and not in accordance with Drake fitting instructions.
  2. Are subject to misuse and abuse, negligence, alteration, or accident.
  3. Are repaired or altered by anyone other than a Drake approved repairer in such a way as to adversely affect the products performance.
  4. Any repair using other than genuine Drake repair parts

Parts and Assembled Components
Drake Trailers, or any of its subsidiaries, warrants that all brand-new parts and assembled components sold by it are to be free from defects in material and workmanship and are therefore guaranteed for 6 months. This warranty does not apply to:

• 1. Parts and assembled components installed by anyone other than Drake Trailers Pty Ltd.
  2. Third party brand On-highway parts and assembled components sold by Drake Trailers.
  3. Hydraulic Hose and fittings.

These products are covered by the manufacturers’ warranties.

Repairs and Services
Drake Trailers hereby warrants the quality of workmanship and materials used during trailer servicing, repair, or rebuild for 6 months from completion of work as indicated on the invoice.

• 1. This warranty covers any defects or issues arising solely from the services provided by the Company during the specified period.
  2. All maintenance work performed on the trailer will be carried out in a professional and competent manner, adhering to industry standards.

4. Warranty Exclusions:

This warranty does not cover the following:

• 1. Normal wear and tear, including tyre wear, brake pad wear, and paint fading.
  2. Damage caused by accidents, misuse, neglect, or improper maintenance.
  3. Modifications or alterations to the trailer made by parties other than the Company.
  4. Damage or defects due to environmental factors, including but not limited to weather, corrosion, and rust.

5. Make Goods:

If a defect in material or workmanship is found during the warranty period, Drake Trailers will, during normal working hours and at the place of business of Drake Trailers or other source approved by Drake Trailers:

• a. Provide new or assembled components or repair needed to correct the defect.

Note: New parts or assembled components provided under the terms of this warranty are warranted for the remainder of the warranty period applicable to the parts or assembled components being replaced as if such parts or assembled components were the original parts or assembled components. Items replaced under this warranty become the property of Drake Trailers.

• b. For all products covered by this warranty; provide reasonable and customary repair labour needed to correct the defect if the product is found to be defective provided it was originally installed by Drake Trailers Pty Ltd and its replacement is reinstalled by Drake Trailers, or another source approved by Drake Trailers.

6. Transparent Communication:

Before any work is carried out, we will provide you with a detailed explanation of the required services, associated costs, and estimated timelines. This ensures that you are fully informed and can make decisions that align with your needs and budget.

7. Continuous Improvement:

8. Customer Satisfaction:

Your satisfaction is our goal. If, for any reason, you are not satisfied with the workmanship of our manufactured items, services, or repairs, please reach out to our service team. 9. Limitation of Liability:

The Drake Group shall not be held liable for any consequential damages, losses, or expenses incurred because of the goods and services we supply. This includes, but is not limited to, loss of profits, loss of use, inconvenience, any indirect, incidental, or special damages arising from the use of our products or services.

Drake Trailers is not responsible for:

• 1. Failures resulting from any use or installation that Drake Trailers judges improper.
  2. Failures resulting from attachments, accessory items and parts not sold by Drake Trailers.
  3. Failures resulting from abuse, neglect, and/or improper storage or repair, including installation or parts and assembled components in contaminated systems.
  4. Failures resulting from user’s delay in making the product available after being notified of a potential product problem.
  5. Failures resulting from unauthorised repair or adjustments and unauthorised fuel-setting changes.

10. Fair Resolution of Issues:

In the unlikely event that you encounter any issues related to workmanship, please contact our customer service team immediately. We will work diligently to resolve the matter in a fair and timely manner, aiming to exceed your expectations and maintain your trust in our brand.

11. Transferability:

This warranty is non-transferable and applies only to the original owner of the trailer who had the servicing, repair, or rebuild work performed by the Company.

Drake’s sole obligation under this warranty is to repair or replace at its option, any unit or part, which returned to Drake all freight charges being prepaid and which by examination shall disclose to Drake’s satisfaction to have been defective. Drake shall not accept any charges for any repair work unless authorized in writing by it.

This warranty is expressly in lieu of any other warranties, express or implied including any warranty of merchantability or fitness for a particular purpose.

Drake Trailers is not responsible for incidental or consequential damages.

Drake Trailers excludes all liability for or arising from any negligence on its part or on the part of any of its employees, agents, or representatives in respect of the manufacture or supply of goods or the provision of services relating to the goods.

Neither this warranty nor any other condition or warranty by Drake Trailers, express or implied (subject only to the mandatory rights), is applicable to any item Drake Trailers sells that is warranted directly to the user by its manufacturer.

If the mandatory rights make Drake Trailers liable in connection with services or goods, then to the extent permitted under the mandatory rights, that liability shall be limited at Drake Trailers’s option to (a) in the case of services, the supply of the services again or the payment of the cost of having the services supplied again and (b) in the case of goods, the repair or replacement of the goods, the supply of equivalent goods, the payment of the cost of such repair or replacement or the acquisition of equivalent goods.
